Although the number of domestic violence incidents has decreased, there is still a huge base. The self prosecution nature of the crime of abuse has not achieved its expected effect, but has instead dampened the liti-gation enthusiasm of the victims.Family members should have higher obligations towards each other and should not reduce the punishment for domestic violence due to family relationships. At a similar level of injury, the sentencing should be basically equivalent to the crime of intentional injury,or when the consequences are serious,it should be directly punished as the crime of intentional injury.Whether cohabitation can be included in the underlying concept of"family"is related to the regulatory aspects of domestic violence laws, and non illegal cohabitation relationships still cannot be protected due to their lack of legalization.Attention should be paid to the relative transfer of privacy rights and the Stockholm phenomenon in domestic violence incidents.
