The Definition of Inferential Information in the Perspective of Algorithmic Governance
The popularization and iteration of algorithmic inference, while promoting efficient lifestyles, also generate risks involving data subject discrimination and privacy invasion, which have a non-negligible impact on the basic rights of data subjects. To varying degrees, the generality of framework legislation and the ambiguity of academic research have caused confusion in the under-standing of the conceptual relationship between information generated by algorithm inference and personal information, implying the contradiction between technological progress and individual pro-tection.In order to change this phenomenon, the risk picture of algorithmic inference should be clarified from the perspectives of ethical risks and legal risks, and the risk prevention and conflict resolution capabilities of algorithmic governance should be strengthened. At the same time,it is necessary to clarify the concept and boundaries of algorithmic inference from the perspective of personal information, strengthen the positioning and boundaries of algorithmic inference from the perspective of rights protection, reveal the contradiction between algorithmic inference and personal privacy and data protection, and then enhance the personal rights of data subjects in order to weaken the data controller's control over inferences.
