Legislative co-opetition of drug money laundering crime and its improvement
Due to the legislative setting of the behavior type,drug money laundering crime and related crimes in China will have multiple legal co-opetition relationships,including legal co-opetition with upstream crimes such as drug transportation crimes,parallel co-opetition with drug crimes such as illegal possession of drugs,and inferior co-opetition with crimes of covering or concealing criminal proceeds or criminal earnings and money laundering crime.Most of these legal co-opetition relationships are crossed co-opetition relationships,while some are inclu-sive co-opetition relationships.The absolute principle of heavier law over lighter law in the legal co-opetition be-tween drug money laundering crime and related crimes has greatly compressed the existence of drug money laun-dering crime.In the future,China should abolish the drug money laundering crime in Article 349 of the Criminal Law from a legislative perspective.
