Analysis on the path to improve the medical parole system from the perspective of judicial practice
The medical parole system,as an important system of criminal punishment execution in China,reflects the Party and government's protection of the right to life and health of criminals.In practice,the initiation proce-dure of execution outside prison lacks specific operational specifications.Some criminals take advantage of loop-holes in laws and regulations to apply for medical parole in violation of regulations to evade supervision.The a-bove situation not only seriously affects the credibility of the judiciary,but also poses a potential threat to the har-monious and stable social order.In this regard,the procuratorate should start from improving the medical security capacity of prisons,improving the legal regulation of medical diagnosis,exploring the parole approval system of the trial model and strengthening the supervision of medical parole to effectively resolve the problems existing in the current medical parole system,so as to better maintain judicial justice and improve the level and capacity of social governance.
