摘要
公安情报在刑事诉讼中扮演至关重要的角色,是推动案件侦破、保障司法公正、打击犯罪的关键要素.公安情报有效转化为刑事证据对提高案件的侦破效率和法庭审判的公正性具有重要意义.从公安情报、刑事证据的概念、特点入手,梳理二者存在的共性与区别,研究公安情报向刑事证据转化的基本模式和路径,发现当前转化机制存在立法尚存缺漏、制度有待完善、实践操作困难等突出问题.为解决当前困境,应当强化立法建设、探索情报转化证据制度、推动情报工作重心向证据倾斜,以便完善公安情报向刑事证据转化机制,确保全程在法治化、规范化的轨道上运行.
Abstract
Public security intelligence plays a crucial role in criminal proceedings,serving as a key factor in pushing forward case investigations,safeguarding judicial impartiality,and combating crimes.Effective transformation of public security intelligence into criminal evidence is of great significance in improving case investigation efficiency and ensuring the fairness of judicial trials.Starting from the concepts,features,and existence of public security intelligence and criminal evidence,this paper analyzes the similarities and differences between them,studies the basic transformation patterns and pathways of public security intelligence into criminal evidence,and finds that the current transformation mechanism faces prominent problems such as a lack of legislation,an imperfect system,and difficulties in practical operation.In order to address the current predicaments,efforts should be made to strengthen legislative construction,explore intelligence transformation evidence systems,and promote the focus of intelligence work to tilt to evidence,so as to improve the mechanism of transforming public security intelligence into criminal evidence to ensure that it runs in a legalized,standardized track.
