A Comparative Analysis of the Post-War Treatments toward War Crimes after the Two World Wars
After the two world wars,the international community,dominated by the victorious countries,dealt with war crimes committed by the defeated countries.Due to the different natures of the two world wars,the victorious countries dealt with war crimes in different ways.After World War I,in order to safeguard their hegemony,the victorious countries demanded the"war responsibility"of the defeated countries one-sidedly,mainly focusing on"war reparations",which eventually led to the breakdown of war crime trials.After World War Ⅱ,the anti-fascist allies generally adopted a cooperative attitude to accurately de-fine the jurisprudential scope of fascist war crimes,and truly carried out punishments by the international military courts,laying the foundation for the theoretical interpretation of war crimes in the modern interna-tional law.In comparison,the handling of fascist war crimes after World War Ⅱ reflected the juridical im-provement of the international community.Although it had its limitations in practice and has left some neg-ative legacy,its legitimacy and justice cannot be doubted.
