英国资产阶级革命不只是政治革命,也是经济社会革命.革命确立的议会主权原则逐步落实,使公司制度发生结构性变迁:公司从"国王之子"转变为"国家之子";公司财产权由国王颁发特许状确认,转变为由议会立法确定;公司股份从受限制转向允许资本平等准入;公司法人外部主体性日益增强,并在空间层面不断扩张.革命后的英国公司不仅是整合国内资本力量的重要平台,而且成为新兴资产阶级控制国内外市场、巩固统治、对外扩张和殖民掠夺的重要工具.
Abstract
The English Bourgeois Revolution was not only a political upheaval,but also an economic and social transformation that significantly impacted the modern English company system.The principle of parliamentary sovereignty established by the revolution influenced the development of the company system,transforming the modem English company from a"child of the king"to a"child of the nation",shifting control of corporate property rights from the sovereign to parliament,and the basis of corporate participation from limited membership to equal capital access,while also strengthening and broadening corporate personhood.After the Revolution,English corporations became the major platforms for the integration of domestic capital,and major protagonists in the control of foreign and domestic markets,the consolidation of capitalist politics,and the colonialist policies of aggression,expansion and plunder.
