本文将采用历史资料分析和对比研究的方法对清朝叩阍制度进行研究分析.首先,对叩阍制度的定义进行明晰,梳理其历史渊源,将其与京控进行对比,明确叩阍制度的外延与内涵.其次,对清朝时期叩阍制度的律文条例进行整理,明确清朝政府对叩阍制度的规定.最后,整理清朝叩阍案件的审理程序,探究叩阍制度是如何运行的,并结合当时案例,分析叩阍制度的运行效果.
Abstract
This paper studies and analyzes the Kouhun system in Qing Dynasty with historical data analysis and comparative research methods.Firstly,it clarifies the definition of the system,sorts out its historical origin,compares it with Beijing control,and clarifies the denotation and connotation of the Kouhun system.Secondly,it sorts out the legal regulations of the system in Qing Dynasty,and makes clear the regulations of it by the Qing government.Finally,it organizes the trial procedures of Kouhun cases in Qing Dynasty,explores how the system operates,and analyzes the effectiveness of the system based on cases at that time.
