Research on the Administrative and Judicial Effectiveness of Party-Government Joint Documents:Analysis Based on 100 Administrative Adjudication Documents
The joint publication of party-government documents,due to its dual nature of party regulations and administrative regulations,may have a significant impact on the responsibilities of relevant agencies and public rights and obligations,thus having the possibility of entering administrative judicial trials.An analysis of 100 such documents has found that disputes often focus on two aspects:information disclosure and judicial review.In judicial practice,party-government joint publications are usually not included in the list of administrative normative documents,but only serve as a reference for judges to make judgments and reasoning.In order to fully leverage the functional value of the documents and alleviate the tense relationship between them and current judicial application rules,it is necessary to clarify their legal source status,establish substantive review standards,and improve the judicial relief system to enhance their legitimacy and standardization in administrative judicial practice,thereby promoting the modernization process of the national governance system and governance capacity.
