The Legal Regulation of Blockchain Empowering Rural Environmental Governance
The modernization of rural environmental governance is an important part of Chinese moderniza-tion.Currently,the rural environmental governance has many constraints like the lack of consensus on main-taining"common ecological interests",the imperfect mutual trust mechanism of multi-subject coordination,and the insufficient security of platform-based governance data,which can be handled through the blockchain empowering.The advantages of blockchain,namely,decentralization and collective maintenance,can lead to normative and orderly rural environmental governance and diversified mutual trust of governance subjects and thus can be used to build a new theoretical framework,technical thinking,and value foundation for Chi-na's rural environmental governance.In practice,the application of blockchain in rural environmental gover-nance still faces many institutional challenges:the challenge posed to public maintenance of the governance by decentralization of blockchain,the challenge to the rights protection of the governance by instrumental ra-tionality of blockchain,and the challenge to the governance rule system by rapid iteration of blockchain.It is therefore necessary to give priority to the publicity of rural environmental governance,construct a new frame-work of power restriction and rights protection under the synergy of technical and legal governance,and con-stantly improve the technical regulations of blockchain risk in rural environmental governance.
