The Boundary of Rule of Law in Digital Procuration
Digital procuratorial reform,aiming to address issues of legal oversight like"passivity","fragmenta-tion",and"superficiality"through digitalization's empowering of legal oversight,is a penetrating,case-based and integrated form of legal supervision.From the perspective of supervision process of digital procuration,it's found that digital supervision has the problems of ambiguous boundaries of the rule of law in supervision content,data acquisition,technological application,and supervision procedures,posing risks for its alien-ation.As the definition of the boundary of rule of law of digital procuration is the foundation of its continued stable development,from a procedural perspective,it is essential to clarify that the supervision content of digital procuration should adhere to legal principles horizontally and focus on key issues of public concern vertically,and data acquisition should comply with principles of proportionality,cost control,data security and personal information protection.In technological application,the principle of cost control should be main-tained in technology selection;introduction of technology should fulfill the procedures of algorithm filing and expert evaluation;and technology operation should conform with principles of technological assistance,trans-parency,and participation.Supervision procedures should adhere to norms like case-based,collaborative and post-event supervision.
