A Legal Dogmatic Analysis of the Right of Party Members to State Different Opinions from the Perspective of Rule-Based Governance of the Party
Rule-based governance of the Party is the basic way to comprehensively and strictly administrate the Party,legal dog-matic being an important methodology for this.Using democratic centralism as an analytical framework,a normative system can be established to safeguard and restrict the right of Party members to express different opinions.The Party organization has always re-spected and guaranteed the right of Party members to express different opinions,but when the intention of the Party organization is determined and externalized through legal procedures,it becomes a key node in the application of the normative system for Party members to express different opinions.Prior to the node,Party members can express their different opinions truthfully,as long as the opinions themselves do not violate discipline.After the node,as long as Party members resolutely implement the decisions of the Party organization,they can still declare their reservations to different opinions and continue to empress them to the high-er-level Party organization,but there should be limitations on the objects and methods.
