Theoretical Expansion and Institutional Construction of Digital Legal Supervision over Fake Arbitration
Fake arbitration has surfaced as a problematic area for prosecutorial supervision due to its secrecy.The limited court revoking power and the inadequate internal control have made strengthening prosecutorial supervision of fake arbitration necessary.Nonetheless,the current"indirect supervision"model has restricted prosecutors'regulation of fake arbitration,weakening the prosecutorial investigation of the problem.One way to resolve the concern is applying digital prosecution to fake arbitration.Digital prosecution faces new challenges,such as enhancing theoretical and system construction.Prosecutors'authority to oversee fake arbitration comes from the prosecutorial supervision power prescribed in the Constitution.It is important to establish positive perceptions of prosecutorial supervision.Collaborative governance shall be launched to collect fake arbitration information,and algorithmic tools can be used to identify fake arbitration.Besides,the limitations and standardization of digital prosecutorial supervision over fake arbitration should also be clarified.
