Corporate Compliance as a"Govern Method":Dual Concept,Structural Remodeling and Practice
The institutional connotation of corporate compliance lies in guiding and motivating enter-prises to proactively identify risks,prevent crimes and stop crimes.From the internal connection between"govern method"and corporate compliance,it can be seen that corporate compliance as a"govern meth-od"of corporate internal governance has the inherent consistency with"govern method"of national crimi-nal governance and the knowledge system of"govern method".Based on this,in order to achieve the methodology construction of corporate compliance and embed compliance into the legal norm system,it should firstly complete the conceptual innovation of corporate compliance as a"govern method",when im-plementing requirements of cooperative justice and preventive criminal law concepts,it should reshape the compliance negotiation governance structure and the judicial mitigation governance structure.In the specif-ic practice process,we should shift from responsibility to normalized management,from case handling to crime prevention,so as to reshape the methodological system of corporate compliance and play the institu-tional and methodological role of corporate compliance.
