摘要

网约车司机与平台之间究竟属于哪种类型的劳动用工关系,这在学界和法律实务部门都是至今尚未能形成定论与共识的话题.域外相关国家及其地方政府和司法机关的认识也存有差异,但基本判断似乎越来越接近.即网约车司机属于具有稳定使用关系的"工人",而不是具有稳定雇佣关系的"雇员".这种既具备稳定使用关系,又具有相对劳动自由度的新型劳动者,在法律上并没有摆脱用工方对其进行的控制与监督管理,也没有摆脱经济上的从属性,因而应该被纳入劳动法的调整与保护范围.现有工厂制时代形成的劳动法体制,应根据网络用工的特点和要求做相应的调整,以能够覆盖和保护网络从业劳动者的合法权益.

Abstract

What kind of labor and employment relationship between online taxi-hailing drivers and platforms is still a topic that has undecided conclusion and consensus in academics and legal practice departments.There are also differences in the understanding of relevant foreign countries and their local governments and judicial organs,but the basic judgment seems to be getting closer.That is,online taxi-hailing drivers are"workers"rather than"employees"with stable employment relations.This new type of laborer,which has both stable employment relationship and relative labor freedom,has neither got rid of the control,supervision and management of the employer in law,nor the economic subordination.Therefore,it should be included in the adjustment and protection scope of Labor Law.The existing Labor Law system formed in the era of factory system should be adjusted according to the characteristics and requirements of network employment,so as to cover and protect the legitimate rights and interests of network laborers.
