摘要
游戏模组引发的法律争议的核心是其可版权性和作品属性.作为一种特殊的程序,游戏模组的构成和运行逻辑类似于视频游戏,因此也继承了视频游戏的著作权争议,有必要通过回应视频游戏著作权争议来扫除探讨游戏模组著作权的前置障碍.游戏模组本身的构成比较特殊,既包括底层程序又包括和游戏结合后的效果,因而在判断游戏模组的可版权性时,需要根据其新增效果及与原游戏的结合程度来界定游戏模组作为作品的边界,并从多个角度考量其所包含的美术、文字、音乐以及游戏规则、角色等特有的游戏元素的独创性,不具备独创性的游戏模组不被视为可保护作品.探讨游戏模组的原创可能性可以参照"绝对原创+屏蔽"标准,对于其是否构成演绎作品则要结合客观比较和主观感受两个层面进行分析.
Abstract
The core of the legal disputes triggered by game mods lies in their copyrightability and work attributes.As a special type of program,the composition and operational logic of game mods are similar to video games,thereby inheriting the copyright disputes of video games.It is necessary to address the copyright disputes of video games as a preliminary step in discussing the copyright of game mods.The composition of game mods is unique,comprising both the underlying programming and the effects after the integration with the game.Therefore,when determining the copyrightability of game mods,it is crucial to define the boundaries of game mods as works based on their added effects and degree of integration with the original game.This includes considering the originality of various game elements such as art,literature,music,as well as game rules and characters from multiple perspectives.Game mods lacking originali-ty are not considered protectable works.In exploring the originality of game mods,one can refer to the"absolute originality+bloc-king"standard.Whether a game mod constitutes a derivative work should be analyzed based on a combination of objective comparison and subjective perception.
