Culture of judicial protection for human rights(CJPHR),as an important part of excellent Chinese traditional culture,has a long history and unique institutional form.The CJPHR in China is rooted in cautious punishment,integration of laws and compassion,and harmony without litigation.It has deeply influenced the judical practice in China.It is also a modern inheritance path.It is imperative for the CJPHR to rely on Chinese-style modernization that is the latest theoretical achieve-ment.In order to achieve the modernization of inheritance of the CJPHR,it is necessary to draw on and integrate excellent ju-dicial protection experiences around the world.The inheritance based on China's situation adheres to China's characteristics,and holds firmly on the people-oriented concept as well.
