论数字政府治理中人工智能辅助行政复议制度

摘要
数字政府治理实践中,行政复议程序需遵循相应数字法治逻辑.行政复议程序具有实体公正、程序效率、民主管理的价值取向.为契合其应然价值,数字政府治理中的行政复议程序应有防范数字政府权力扩张、弥合数字转型规范迟滞、探索协同治理实践方案三重功能.行政复议的功能定位使得人工智能辅助复议可以促进合法行政、推进高效行政、保障民主行政.为构建人工智能辅助行政复议制度,必须保证人工智能辅助行政复议在技术上能够实现,必须厘清人工智能辅助行政复议的规范体系,必须完善人工智能辅助行政复议的救济路径.
Abstract
In the practice of digital government governance,the administrative review procedure needs to follow the corresponding digital legal logic.The administrative review procedure has the value orientation of substantive justice,procedural efficiency and democratic management.In order to fit its proper value,the administrative review procedure in digital government governance has three functions:preventing the expansion of digital government power,bridging the delay of digital transformation norms,and exploring the practice plan of collaborative governance.The functional orientation of administrative reconsideration makes artificial intelligence-assisted reconsider-ation have the practical significance of promoting legal administration,promoting efficient administration and guaranteeing democratic administration.Build the specific system of artificial intelligence assisted administrative review,explain the possibility of artificial intel-ligence assisted administrative review technology,clarify the standard system of artificial intelligence assisted administrative review,and improve the relief path of artificial intelligence assisted administrative review.
