Dong Zhongshu's Influence on the Trial of the Huainan King Case:An Analysis Based on Shiji and Hanshu
In the absence of personal participation,Dong Zhongshu still had an important influence on the trial process of Huainan King.Although Lv Bushu was not recommended by his teacher Dong Zhongshu as chief judge,Emperor Wu of Han appointed him as chief judge mainly because he was Dong Zhongshu's disciple,ho-ping that he could try the Huainan king's case with Dong Zhongshu's ideas.The facts proved that Lv Bushu was indeed sentenced to prison based on the Spring and Autumn Annals,and his trial basis of no offense to the mon-arch and parents was influenced by Dong Zhongshu's Gongyang theory of the Spring and Autumn Annals.On the contrary,the trial of Huainan King's case promoted the Confucianization of law,which basically laid the direc-tion for later generations to declare the illegality of conspiracy by judicial judgment,and the principle of no of-fense to the monarch and parents gradually became the legal basis for determining the crime of conspiracy,which was formally written into legal provisions in Tanglvshuyi.
