Legal Protection of the Representative Inheritors of the Intangible Cultural Heritage in the Multi-cultural Space
The design of China's legal system has strict provisions on the identification and management of representative inheritors of intangible cultural heritage in the field of public law,but there are obvious deficien-cies in rights protection,mainly manifested in the unclassified protection regulations and an imperfect withdrawal mechanism,which makes it difficult to mobilize the enthusiasm and initiative of inheritors.The inheritance effect is not good.In order to promote the living inheritance of intangible cultural heritage,the multicultural space the-ory can be used to comprehensively understand the"real human"identity of the representative inheritors of in-tangible cultural heritage,balance the development requirements of public law and private law,and distinguish different cultural spaces in inheritance activities to confirm representativeness.The private rights enjoyed by in-heritors,especially intellectual property rights,should be classified and protected for representative inheritors,and the exit mechanism for representative inheritors should be improved.The representative inheritor system should be continuously improved to better protect intangible cultural heritage.
