摘要
河长制是理论与实践结合、科学原理与中国国情结合的产物,是我国流域管理制度上的一大创举,也是我国流域管理体系中将法治与行政相结合的构架与主体.本文就河长制的背景、环境法制、国内外流域管理体系等说明河长制的本质是环境法的制度载体,河长制的目的是责权的统一,并分析河长制在我国实践三年以来的成效与问题,提出流域管理的发展趋势是向着智能化、法制化、标准化、系统治理的方向发展,以期可以为制度的优化与研究提供参考.
Abstract
The river chief system is the product of the combination of theory and practice,scientific principle and China's national conditions,is a major initiative in Chinese basin management system,and is also the framework and main body of the combination of rule of law and administration in Chinese basin management system.Based on the background of river chief system,environmental legal system,and basin management system at home and abroad,this paper explained that the nature of river chief system was the institutional carrier of environmental law,and the purpose of river chief system was the unification of responsibilities and rights.It also analyzed the effectiveness and problems of river chief system since its practice in China for three years,and pointed out that the development trend of river chief system was to develop in the direction of intelligence,legalizatio n,standardization and systematic governance.In order to provide reference for system optimization and research.
