摘要
市场化、法治化破产离不开司法与行政的共同发力,在这一共识下,遍地开花的府院联动实践积极响应了现实需求,对提升破产审判质效、发挥破产制度功能产生了积极作用.府院联动机制根源于政策性破产的历史传统,在市场化破产过程中仍然不可或缺,可谓是我国最具特色的破产机制.在优化营商环境的背景下,府院联动机制仍有"进化"的空间和必要.面对目前破产法实施过程中存在的观念错位和制度缺位,府院联动"前置",为破产主体提供破产前的识别、咨询与协调服务,优化破产"入口"端,应该成为促进破产提质增效不可忽视的新路径.
Abstract
Market-oriented and rule-of-law bankruptcy cannot be separated from the joint efforts of the judiciary and the administration.Under this consensus,the blossoming practice of government-court linkage has positively responded to the real needs,and has positively contributed to the enhancement of the quality and efficiency of bankruptcy trial and the function of bankruptcy system.Rooted in the historical tradition of policy bankruptcy,the government-court linkage mechanism is still indispensable in the process of market-oriented bankruptcy,and can be regarded as the most distinctive bankruptcy mechanism in China.Under the background of optimizing business environment,the government-court joint mechanism still has the space and necessity of"evolution".In the face of the conceptual mismatch and institutional deficiency existing in the implementation of the current bankruptcy law,the"front"of the government and the court linkage to provide the bankruptcy subject with pre-bankruptcy identification,consulting and coordination services to optimize the bankruptcy"entrance"should become a new path that cannot be ignored to promote the bankruptcy to enhance the quality and increase the effectiveness of the bankruptcy.It should become a new path that cannot be ignored to promote the improvement of quality and efficiency of bankruptcy.
