企业合规的刑行衔接制度构建

摘要
涉案企业合规整改在我国法治体系中的作用愈发显著.在此过程中,司法与行政机关之间的分工配合尤为重要,行政机关一方面通过事前的监督与预防来促使企业建立完备的合规体系;另一方面能够与司法机关一起对涉案企业进行合规治理.然而,由于当前缺乏明确的法律规范,二者在合规整改方面的适用标准有所差异,且二者并无隶属关系,分属不同系统,使得涉案企业合规整改的刑行衔接在程序和实体部分均有所掣肘.鉴于此,有必要建立统一的涉案企业合规整改评估标准,探索涉案企业合规整改的刑行衔接路径,使其更加规范和细致化,优化制度架构与营商环境.
Abstract
The compliance rectification of the enterprises involved in the case plays an increasingly important role in the legal system of our country.In this process,the division of labor and cooperation between the judicial and administrative organs is particularly important.On the one hand,the administrative organs urge the enterprises to establish a complete compliance system through prior supervision and prevention;on the other hand,they can conduct compliance governance with the judicial organs.However,due to the lack of clear legal norms at present,the applicable standards of the two companies in compliance rectification are different,and they have no subordination relationship and belong to different systems,which makes the connection between punishment and execution of compliance rectification of enterprises involved in the process and the entity limited.In view of this,it is necessary to establish a unified compliance rectification evaluation standard for the enterprises involved,explore the connection path between punishment and punishment for compliance rectification of the enterprises involved,make it more standardized and detailed,and optimize the institutional structure and business environment.
