Contemporary Characterization of Data Cross-Border Flow Rules Under the CPTPP Framework and China's Response
[Research purpose]This paper compares the current cross-border data flow rules and analyzes the development direction of China's cross-border data flow rules combined with the CPTPP era background.[Research method]The concept and characteristics of cross-border data flow rules under the CPTPP framework are analyzed,and specific models formed by different representative countries are extracted to provide reference for China to optimize its cross-border data flow rules.[Research conclusion]Current rules on cross-border data flows can be grouped into four categories,and China's request to join the CPTPP reinforces the need for China's rules to strike a bal-ance between data security and free flow.In the future,we can respond to the above needs by comprehensively improving the transparency of cross-border data flow supervision,improving the impact assessment rules of cross-border data flow supervision,reasonably defining the exception clauses of cross-border data flow rules,and building a protection mechanism for data classification.
