The Causes and Relief of the Decline in Criminal Law Regulation of Cyber Violence
Cyber violence has become an unavoidable problem in the field of criminal law.However,the current criminal law response to cyber violence is showing a decline.The reason for this is that,on the one hand,the anonymity,mixed behavior,and"many to one"nature of cyber violence make it difficult to identify the regulatory targets of cyber violence;On the other hand,There are many shortcomings in the charges related to the governance of online violence.And although there is a judicial interpretation,it is not specifically formulated for the governance of online violence,so the response is weak.In order to resolve this decline,the regulatory targets of cyber violence should be limited to primary creators,organizers,and initiators.At the same time,we should adhere to the method of criminal law hermeneutics to interpret related charges in the direction of network violence governance,so as to make them applicable,rather than adding"network violence crimes"in criminal law.
