认罪认罚从宽协商程序的独立构建理路

摘要
独立的认罪认罚从宽协商程序不仅是全面实施认罪认罚从宽制度的内在要求,也是提升认罪认罚从宽制度的关键举措,故创建独立的认罪认罚从宽协商程序势在必行.通过独立的认罪认罚从宽协商程序,可以实现人权保障价值、程序正义价值、程序简化价值以及程序公开价值的统一,使其具有充分的合理性与必要性.从本体上看,独立的认罪认罚从宽协商程序包括启动时间与方式、协商内容与方式、结果确认等运行要素,以此夯实独立性的基础.为了更好地构建认罪认罚从宽协商程序,还需强化配套机制建设,包括构建相对独立的自愿性审查程序、确保认罪认罚证据开示及同步录音录像,保障控辩双方的撤回权、协商结果的上诉与抗诉、强化认罪认罚案件庭审程序的实质化等.
Abstract
It is imperative to establish an independent negotiation process of leniency on admission of guilty and acceptance of punishment is imperative,which is not only an intrinsic requirement for the full imple-mentation of the system of leniency on admission of guilt and acceptance of punishment,but also the key meas-ure to improve it.The value of human rights protection,procedural justice,procedural simplicity and procedur-al openness can be well achieved through an independent negotiation process of leniency on admission of guilty and acceptance of punishment,making it fully rational and necessary.Ontologically,an independent system of leniency on admission of guilt and acceptance of punishment includes an negotiation process of leniency on ad-mission of guilty and acceptance of punishment,as well as the time and manner of initiating the negotiation process of leniency on admission of guilty and acceptance of punishment,the content,manner and confirmation of the results of the negotiation process of leniency on admission of guilty and acceptance of punishment,and other operational elements,thus consolidating the foundation of independence.Looking forward,in order to better facilitate the negotiation process of leniency on admission of guilty and acceptance of punishment,it is al-so necessary to strengthen the construction of supporting mechanisms,including the construction of a relatively independent voluntary review process,the disclosure of evidence and synchronized audio-visual recording of the system of leniency on admission of guilt and acceptance of punishment,the protection of the right of with-drawal of both the prosecution and the defense,and the appeal and protest of the results of the bargaining process,strengthening the substantiation of the trial procedure for cases of confession and punishment,among other prominent aspects.
