摘要
专门教育在适用中存在理论指引缺位、条件对象模糊、程序杂糅等问题,导致其内部存在适用不协调甚至混同适用的情形.国家亲权理论要求专门教育适用必须坚持贯彻一元保护主义与最后性原则.普通专门教育与专门矫治教育适用的核心要件均为监护人无监护能力,通过对部分罪错未成年人指涉范围的实质限缩或扩张可以发现,两者的适用对象并不存在交叉.普通专门教育适用程序具有行政属性,专门矫治教育适用程序具有准司法属性,这一结论具有实定法依据.在此基础之上应以专门教育指导委员会为枢纽,组建具有二元属性、双重工作模式的专门教育指导委员会,以重塑专门教育适用程序并构建不同程序间的衔接机制.
Abstract
In the application of specialized education,there is a deficiency in theoretical guidance,am-biguous conditions and muddled procedures,leading to uncoordinated or even mixed application within it.The State's theory of parental authority requires that the application of specialized education must adhere to the prin-ciples of monist protectionism and finality.The core element applicable to both general specialized education and specialized correctional education is the incapacity of the guardian,and it can be found that there is no crossover between the objects of application of the two through the substantial limitation huo or expansion of the scope of the reference to some of the minors who are at fault for their crimes.The conclusion that the procedures for applying general specialized education have administrative attributes and those for applying specialized cor-rectional education have quasi-judicial attributes is based on positive law,on the basis of which a specialized education steering committee should be set up as a pivotal point,with dual attributes and dual working modes,in order to reshape the procedures for applying specialized education and to construct a mechanism for linking the different procedures.
