专门矫治教育制度的完善路径——以澳门地区收容制度为借鉴

专门矫治教育作为一个新概念、新制度,规定在《刑法修正案(十一)》和修订后的《预防未成年人犯罪法》当中.与之前的收容制度相比,专门矫治教育制度更贴合当下社会的现状,闪烁着人文关怀和宽严相济的刑事政策精神,但受限于自身的不足,在适用的过程中并不能完全发挥其效用.通过对专门矫治教育措施和我国澳门地区收容措施的发展进程、措施内涵、执行主体和程序等方面进行阐述,比较两者之间的不同,借鉴澳门地区收容措施的可取之处,以期对专门矫治教育制度的不足之处提出完善建议,在最大限度地保护和挽救迷途未成年人的同时,也达到维护社会安定的效果.
Abstract
The new concept and new system of special correction education are stipulated in the revised Criminal Law Amendment(XI)and the Law on the Prevention of Juvenile delinquency.Compared with the previous detention system,the special correction education system is more suitable for the current social situa-tion,has the spirit of criminal policy of humanistic care and tempering justice with mercy,and is more humane and scientific.However,due to its own shortcomings,it cannot fully exert its effectiveness in the process of ap-plication.By elaborating on the development process,connotation,execution subjects,and procedures of the specialized corrective education measures and the reception measures in the Macao region of China,comparing the differences between the two,and drawing on the advantages of the reception measures in the Macao region,this paper aims to propose improvement suggestions for the shortcomings of the specialized corrective education system,while maximizing the protection and rescue of minors who are lost,It also achieves the effect of main-taining social order and stability.
