摘要
刑事诉讼中个人信息的处理带来了被遗忘权需求的出现,要求处理个人信息的公权力机关承担相应的被遗忘权国家保护义务.承担刑事诉讼中被遗忘权国家保护义务的主体主要是刑事诉讼中的侦查机关、起诉机关、审判机关和刑罚执行机关,也包括在具体案件中与刑事诉讼产生某种联系的行政机关或监察机关.这些义务主体履行刑事诉讼中被遗忘权国家保护义务的方式主要是删除、封存和匿名化处理.刑事诉讼中被遗忘权的国家保护义务的履行程序包括针对信息主体之申请作出回应、完成主管之特定机构针对信息主体之投诉而作出的指令两个阶段,义务的主体在不履行义务的情形下需承担相应的行政或纪律责任.
Abstract
The need for the right to be forgotten arising from the handling of personal information in crimi-nal proceedings calls for the public authorities responsible for processing personal information to assume the cor-responding state obligation to protect the right to be forgotten.The entities primarily responsible for fulfilling the state obligation to protect the right to be forgotten in criminal proceedings include investigative authorities,pros-ecutorial authorities,judicial organs,and agencies in charge of executing punishments,as well as administra-tive or supervisory authorities that are connected to specific cases in criminal proceedings.The main methods by which these obligated entities carry out the state obligation to protect the right to be forgotten in criminal pro-ceedings are deletion,sealing,and anonymization of information.The procedure for fulfilling the state obliga-tion to protect the right to be forgotten in criminal proceedings includes responding to requests from the subjects of the information and executing directives from the competent authorities in response to complaints from the subjects of the information.The obligated entities are required to assume corresponding administrative or disci-plinary responsibilities in cases of non-fulfillment of their obligations.
