域外罪犯会见的发展趋向及本土化思考

摘要
近年来,域外诸多国家和地区以及国际社会充分认识到罪犯会见在罪犯矫正及预防再犯等方面的重要功能,积极开展罪犯会见领域的基础理论和实证研究,实务部门也积极探索开发会见相关项目与实践,立法部门不断健全完善罪犯会见法律体系,取得了显著成效.域外已有的研究、实践探索及立法完善对健全我国本土化会见体系具有重要意义.我国应重视并加强对会见性质厘清、会见功能界定及会见原则诠释等的基础理论研究,在开展重新犯罪调查过程中持续深入开展加强罪犯会见以预防再犯及代际犯罪的实证调查,推动在基层监狱积极开发着力提升罪犯会见效能的会见项目,同时通过修改完善《监狱法》《罪犯会见通信规定》等不断健全罪犯会见的规范性体系.
Abstract
In recent years,many countries and regions in abroad have fully recognized the important func-tion of prison visitation on correction and prevention of recidivism.Many research institutions have actively car-ried out basic theoretical and empirical research in the field of prison visitation.Many prisons have also actively explored and developed visitation programs for offenders.Some legislative departments have constantly im-proved and perfected the legislative system of prison visitation.Based on these efforts,remarkable results have been achieved.The existing research,practice exploration and legislative perfection abroad have great signifi-cance to the improvement of our local visitation system.China should pay more attention to the basic theoretical research on prison visitation,continue to carry out in-depth empirical investigation on strengthening the of-fender's visitation to prevent recidivism and inter-generational crime in the process of re-crime investigation,and promote the active development of visitation projects in prisons that focus on improving the efficiency of the offender's visitation.Meanwhile,the Prison Law and the Provisions on Visitation and Communicating with Pris-oners also need to be revised in the future.
