罪错未成年人分级矫治公检履职模式研究——以专门教育—观护教育衔接模式为路径

摘要
针对目前专门教育资源供给不充分、准入程序不明确、分级处遇标准不到位,以及公安机关现有矫治措施效果不理想等具严重不良行为的罪错未成年人的教育矫治难题,应以加强制度规范衔接与主体职责对接为基本路径,避免加重公安机关"抓—放—抓"的恶性循环,衡平社会防卫与未成年特殊保护间的价值张力,提高精准教育矫治的质效.以最有利于未成年人原则及国家亲权理念的交织为价值基石,以严重不良行为的社会危害性程度为准入基本界分标准予以分级,并借助家庭监护令的执行情况对自愿性准入模式的实质条件予以评估;以法益侵犯类型为尺度对矫治教育管理模式予以分类;以信息对接、评价对接与监督对接三重维度的公检职责对接机制贯穿专门教育—观护教育衔接制矫治教育体系的运行体制,实现家庭亲权与国家亲权的各自应然担当,助力以新安全格局保障新发展格局.
Abstract
In view of the current educational correction problems of juvenile delinquency with serious bad behaviors,such as insufficient supply of specialized educational resources,unclear access procedures,inade-quate graded treatment standards,and unsatisfactory results of existing correctional measures by public security organs,the basic path should be to strengthen the convergence of system norms and the docking of subject du-ties,so as to avoid the vicious circle of "grasp-release-grasp" by public security organs,balance the value tension between social defense and special protection for minors,and improve the quality and efficiency of pre-cision education and correction.
