摘要
我国受虐未成年人强制报告制度存在强制报告的虐待范围较窄、强制报告义务主体不全面、责任追究机制不严密、报告人保护机制不到位、响应措施不健全等问题.借鉴美国成熟的实践经验,结合我国国情,建立具有中国特色的受虐未成年人强制报告制度,需要精确强制报告的虐待范围,扩大报告主体的范围,增设报告人激励机制,明确未履行报告义务主体的责任追究,并通过构建完备的响应保护措施和机制实现对受虐未成年人全方位的保护和救助.
Abstract
The compulsory reporting system for abused minors in our country has problems such as a limit-ed scope of abuse,incomplete obligation subjects,lax accountability mechanisms,inadequate protection mech-anisms for reporters,and inadequate response mechanisms.Drawing on the mature practical experience of the United States and combining with China's national conditions,establishing a mandatory reporting system for a-bused minors with Chinese characteristics requires precise reporting of the scope of abuse,establishing a repor-ting reward mechanism,strengthening accountability for those who fail to fulfill their reporting obligations,and achieving comprehensive protection and assistance for abused minors through the construction of a complete and timely response mechanism.
