论自诉转公诉制度的立法确立

摘要
我国刑事追诉制度凝聚了历次《刑事诉讼法》修改的结晶,可划分为公诉、自诉和公诉转自诉三种方式.自诉转公诉是刑事追诉概念下的特定一项,在实体、程序及证明等三重维度,具备了当前其他几种追诉方式所没有的价值功用.然而,受制于一系列主客观因素的影响,当下自诉转公诉在实践中存在着诸多问题.因应《刑事诉讼法》再修改的时代契机,对于此一问题的研判与思考不应仅仅囿于理论与实践之现存落差,而是应当以域外视角加以镜鉴,借由廓清自诉转公诉程序转化的弹性判断标准、明晰检察机关介入自诉的途径、统一审判机关处理自诉的方式,演绎归纳出具有中国特色的自诉转公诉基本范式,进而助力刑事追诉制度的优化完善.
Abstract
With the successive amendments of the Criminal Procedure Law,the current criminal prosecution in China still continues the legislative paradigm of the Criminal Procedure Law in 2012,which is divided into three ways:public prosecution,private prosecution and public prosecution to private prosecution.As a special kind of criminal prosecution concept,private prosecution to public prosecution has its unique value and function in three dimensions,such as entity,procedure and proof,which are different from the other three kinds of prosecution.However,subject to a series of subjective and objective factors,there are many problems in the practice of private prosecution to public prosecution in our country.In the light of the opportunity of the revision of the Criminal Procedure Law,the research and thinking on this issue should not only be confined to the existing gap between theory and practice,but should be studied from an external perspective,by clarifying the flexible judgment criteria of private prosecution to public prosecution,clarifying the ways of procuratorial organs to intervene in private prosecution,and unifying the ways of judicial organs to deal with private prosecution.Deduce and summarize the basic paradigm of private prosecution to public prosecution system with Chinese characteristics,and help optimize and perfect the criminal prosecution system.
