摘要
以我国少年法庭40年发展历程为蓝本,总结未成年人司法保护的经验问题,展望未成年人司法保护的未来之路,文章重点分析少年法庭创设的理论基础、发展历程,并比较考察域外经验,并以长宁法院少年法庭成立以来的制度和机制探索为基础样本,剖析当前少年审判运行过程依然存在的突出问题,并提出以体系化建设为基础,以人民法院司法为主导,关注困境未成年人特殊情形,打造体系化的少年审判工作理念、法典化的少年审判专业立法、协同化的少年审判专业机制,以期为我国少年审判改革提供建设性思路.
Abstract
Based on the 40-year development process of juvenile courts in Chinese mainland,this paper summarizes the experience of juvenile judicial protection and looks forward to the future road of juvenile judicial protection,this paper focuses on analyzing the theoretical basis and development process of juvenile courts,and compares and examines foreign experience,and takes the exploration of systems and mechanisms since the establishment of the juvenile court of Changning Court as the basic sample,analyzes the outstanding problems that still exist in the current juvenile trial operation process,and proposes to take systematic construction as the basis and the people's court judiciary as the leading.Pay attention to the special circumstances of juveniles in difficulty,and create a systematic concept of juvenile trial work,codified juvenile trial professional legislation,and coordinated juvenile trial professional mechanisms,in order to provide constructive ideas for China's juvenile trial reform.
