摘要
随着我国经济社会的快速发展,《特种设备安全法》在实施中存在与现实有所脱节的问题,文中从基层检验人员的角度,结合实际工作中遇到的问题,从落实作业人员和乘用人员安全责任、推行特种设备安全责任强制保险、适当调整罚款的形式和额度、禁止行业内的转包和挂靠等方面,叙述了对《特种设备安全法》条款的几点思考,为未来《特种设备安全法》的修订提供参考.
Abstract
With the rapid development of Chinese economy and society,the implementation of the Special Equipment Safety Law of the People's Republic of China is out of touch with reality.In this paper,from the perspective of grass-roots inspectors,combined with the problems encountered in their work,some reflections on the provisions of the Special Equipment Safety Law of the People's Republic of China are described from the aspects of implementing the safety responsibilities of operating personnel and passengers,implementing compulsory safety liability insurance for special equipment,appropriately adjusting the form and amount of fines,and prohibiting subcontracting and affiliation in the industry,so as to serve as a reference for the future revision of the Special Equipment Safety Law of the People's Republic of China.
