油气管道压覆矿产资源评估问题探讨

摘要
近年来,随着全民所有自然资源有偿使用制度的不断完善,在油气管网的规划、建设和运营的过程中遇到了诸多"压覆矿产资源"的问题,给自然资源主管部门审批、油气管道工程建设以及被压覆的矿业权人合法权益的保障带来了阻碍.针对这些问题,该文从保障建设项目顺利实施、维护矿业权人合法权利的角度,就油气管道压覆矿产资源评估工作形势、存在的问题进行了探讨,从强化主体责任、完善审批内容、建立影响评价体系和健全补偿制度等四个方面提出了建议,为后续油气管道压覆矿产资源提供参考.
Abstract
In recent years,with the continuous improvement of the system of compensated use of all natural resources by the whole people,many problems of"overlaying mineral resources"have been encountered in the process of planning,construction and operation of oil and gas pipeline networks,which have brought obstacles to the approval of natural resources authorities,the construction of oil and gas pipeline projects,and the protection of the legitimate rights and interests of mining owners who are overlaying.In view of these problems,this paper discusses the current situation and existing problems in the assessment of compressed mineral resources of oil and gas pipelines from the perspective of ensuring the smooth implementation of construction projects and safeguarding the legal rights of mining owners.Suggestions are put forward from four aspects:strengthening the main responsibility,perfecting the examination and approval content,establishing the impact evaluation system and perfecting the compensation system,which can provide reference for the follow-up of oil and gas pipeline compacting mineral resources.
