城市地下空间确权登记的问题与思考——以山东省济南市、青岛市为例

推动城市地下空间确权登记的科学化、规范化开展,对促进地下空间资源的合理开发利用、保障地下空间权利人合法权益有着积极意义.本文在分析济南市、青岛市城市地下空间登记工作现状的基础上,结合国内外地下空间立法实践,提出城市地下空间确权登记工作合理化建议,通过明确地下空间权属范围、推行权利化确权登记、分类解决地下空间权利冲突、探索不动产三维确权登记、规范登记行为,促进相关争议问题解决、提高山东省地下空间利用效率.
Problems and Thoughts on Right Registration of Urban Underground Space——Taking Ji'nan and Qingdao City in Shandong Province as an Example
Promoting scientific and standardized registration of urban underground space has positive signif-icance in promoting rational development and utilization of underground space resources and safeguarding the legitimate rights and interests of underground space rights holders.In this paper,on the basis of analy-zing present condition of registration of urban underground space in Ji'nan city and Qingdao city,combing with practice of domestic and international legislation on underground space,rationalization suggestions for urban underground space property rights confirmation and registration work have been put forward.Through clarifying the scope of underground space ownership,promoting rights based registration,resol-ving conflicts of underground space rights through classification,exploring three-dimensional real estate registration,and regulating registration behavior.The resolution of related disputes will be improved,and the efficiency of underground space utilization in Shandong province will be promoted.
