摘要
2023 年 9 月颁布实施的《国有企业参股管理暂行办法》明确了国有企业参股投资投前管理、投资决策、投后管理、投资退出等阶段的管理标准,释放了国资委将更加严格管控合规性与风险监管信号.结合该文件政策导向,文章首先对国有企业参股和产权管理进行概述,然后分析国有企业参股公司产权管理存在的风险,最后针对风险提出应对措施,以期对国有企业参股公司的产权管理提供一些思路.
Abstract
The Interim Measures for the Management of Equity Participation of State-owned Enterprises issued and implemented in September of 2023 clarifies the management standards for the stages such as the pre-investment management,investment decision-making,post-investment management,and investment exit of participation investment of state-owned enterprises,releasing the signal that the State-Owned Assets Supervision and Administration Commission of the State Council will strictly control compliance and risk supervision.Based on the policy guidance of this document,in order to provide some ideas for property management in equity participation of state-owned enterprises,the article first provides an overview of equity participation and property management of the state-owned enterprises,then analyzes the risks of property management in equity participation of state-owned enterprises,and finally proposes corresponding measures to address these risks.
