摘要
在"高质量发展"和"走出去"背景下,建筑师负责制在中国的试点方兴未艾,但责任建筑师管控项目的若干痛点始终未能得到有效解决.文章结合国际惯例和国内试点经验,创新性地提出了建筑师负责制项目担保模式,明确了建设单位、建筑师团队和其他参建方的角色定位,并对该模式的投保、索赔程序做出设计.通过项目担保模式,责任建筑师在项目中的权威地位和作为准司法官员的独立性有望得到保障,能更有效管控项目风险,履行专业职责.文章最后从建筑师负责制的制度转型、项目合规责任保障,以及业主支付担保替代三个角度,论述了建筑师负责制项目担保强制推行的必要性.
Abstract
With"high-quality development"and"going global"strategy becoming increasingly important,pilot projects with architects'full services are on the rise in China.However,domestic architects have been facing several major challenges in project management,which have not been effectively addressed.Based on international practice and domestic pilot experience,an"owner's payment guarantee"for architects is put forward in this research.The whole procedures of the guarantee and the responsibility of all stakeholders are designed.With the assistance of this guarantee,architects'authoritative position and independence as quasi-judicial officers in projects are expected to be put into place,enabling them to gain more control over projects and to stick to professional integrity.In the last part,the necessity of compulsory implementation of the owner's payment guarantee is elaborated from three perspectives.
