The Institutional Dilemma and Optimization Path of the Use Right of Idle Residential Land for Stock Shares Under the Background of"Three Rights Separation"
With the advancement of industrialization and urbanization,the problem of idle residential land has become more and more serious,and the traditional system of residential land use right needs to be im-proved.The legislative confirmation of"three rights separation"of residential land has made idle residen-tial land use right as stock shares become a new way of circulation.Through combing the institution and practical investigations of the right to use idle residential land for stock purchase,it is found that there are such problems as the legal provisions scattered and unsound,the price of shares and evaluation standard defective,the income distribution system imperfect and the bankruptcy disposal at risk.This paper sug-gests that the institution should be improved in terms of establishing systematic legal norms,formulating scientific evaluation standards,innovating the income distribution system and setting up a bankruptcy risk prevention system under the required principles of clarifying the idle residential land use right as stock shares.Thus,the economic value of the residential land can be realized,the property income of farmers can be improved and the rural revitalization get aided.
