A Proposal for Improving the System of Copyright Dissemination Rights
The binary system of"on-site"and"remote"copyright dissemination rights still has room for discussion.We should improve this system of copyright dissemination rights along the two logical paths of work dissemination.Firstly,"terminal decoding"should be used as the criterion for dividing"on-site"and"remote"instead of"place of initial propagation".Secondly,the right to mechanical performance should be classified as the right to remote communication.Again,it cannot be required that the terms"dissemination to the public"and"public dissemination"in copyright legislation fully conform to the English expressions in international treaties.Once again,the right of long-distance communication should be further divided into short-range communication right"and"narrow long-range communication right"based on the transmission carrier,namely optical,electrical,and magnetic signals.Once again,it is necessary to distinguish between broad and narrow broadcasting in order to solve the problem of self circulation interpretation of the concept of"broadcasting"in the Copyright Law.In addition,because information network dissemination is interactive broadcasting,the right of information network dissemination also belongs to the narrow scope of remote dissemination.Finally,the extension of projection rights is broad,and the rights related to remote dissemination of works can be protected by a broad definition of projection rights.
