摘要
法律论证研究在中国可以划分为三个阶段:一是法律论证研究的孕育和出场,二是法律论证研究的兴起和迅猛发展,三是新时代的法律论证研究.中国法律论证研究在不同的历史时段具有不同的境遇和任务,亦有不同的理论表现和发展重心.经过几十年发展,法律论证在中国已发展成为一项重要的独立研究课题,形成了诸多研究进路、研究论题和研究团队,并成为指引和引领法学理论和部门法研究的基础理论.同时,中国法律论证研究还面临如何立足于中国文化传统与现实语境,学习镜鉴域外法律论证理论,创建中国自主的法律论证理论等问题.
Abstract
Legal argumentation research in China can be divided into three stages:the first stage of incubation and emergence,the second stage of rise and rapid development,and the third stage of new-era development.Given its different tasks in different circumstances and historical periods,legal argumentation research in China has different theoretical expressions and development focuses.After decades of development,it has evolved into an important independent research topic with numerous research approaches,topics,and teams,as well as a fundamental theory guiding and leading legal theory and the study of specific legal branches.At the same time,it also faces challenges such as how to base itself on Chinese cultural traditions and real contexts,learn from foreign legal argumentation theories,and create an independent Chinese legal argumentation theory.
