Exploration and Practice of Drug Crime Governance Methodology for Procuratorial Organs in Megacities
The international drug crime situation has increased the pressure on drug crime prevention and control in China,and has also had an impact on its types,forms,means,and distribution.The drug crimes in megacities tend to generally decline,which is mainly embodied in drug smuggling,trafficking,transportation and manufacturing.Meanwhile,the proportion of new types of spiritual drugs such as psychoactive substances is increasing,and the proportion of drug crimes in urban downtown areas is relatively high.However,there is a trend of overall decline and movement to suburbs.Procuratorial organs which participate in drug crime governance are fraught with a shift from the traditional criminal prosecution functions of"crackdown"to the"four comprehensive governance",and from focusing on cracking down on supply side to emphasizing both supply and demand intervention.Addressing drug crimes from the"supply side"is confronting the pressure of a surge in international drug crimes and the dilemma of"diminishing marginal effects"caused by severely punishing drug crimes by law.Given that the methodology of governing drug criminal cases faces challenges brought about by difficulties in investigation and evidence collection because of the increase in new types of drugs and the transformation of drug trafficking methods,to explore the methodology of governing drug crime from the"demand side"faces a more austere task.We should use the big data legal supervision model to establish a mode of combating the whole drug chains.While strictly punishing drug crimes by law,we should govern it from the"demand side",intensify the crackdown on new drug crimes and the use of the internet to commit drug crimes,strengthen the supervision of drug substitutes and establish a platform for sharing information on drug-related crimes.
