Practical Puzzles and Countermeasures in Reverse Connection between Administrative Law Enforcement and Criminal Justice
The connection between administrative law enforcement and criminal justice is not only an urgent requisite for building a law-governed government and a law-governed society in China but also an important measure to promote lawful administration and fair justice.In July 2023,the Supreme People's Procuratorate issued a Special Instruction on the Two-Way Connection between Administrative Law Enforcement and Criminal Justice.The extension of such connection obviously includes"positive connection"and"reverse connection".However,in practice,such issues exist in the reverse connection as no criminal penalty,no fine,no transfer,and some of them should be punished or fined.Therefore,it is necessary to analyze the practical difficulties and causes for the current reverse connection in order to improve the reverse connection mechanism especially in terms of system design,platform building,standard procedures,and overall coordination.
