Research on the Judicial Applicable Issues of Hazardous Operation
Guided by the active prevention concept of criminal law,this article,which analyzes the judicial applicable puzzles after the addition of hazardous operation from the normative,substantive,and procedural levels,focuses on discussing the difficulties in evidence collection and the uneven understanding of constituent elements of hazardous operation.Furthermore,it deduces the logical evidence of the addition of hazardous operation in the Eleventh Amendment to the Criminal Law and proves the practical value of the addition of this crime in promoting positive social governance.Based on this,it then suggests the solutions to the judicial applicable puzzles the hazardous operation brings about,which includes judicial agencies'reinforced review and evaluation of evidence,establishment of an evidence-oriented"two law connection"system,etc.so as to promote the standardized and scientific judicial application of this crime,and improve judicial fairness and social governance.
