Discuss the Applicability of the Crime of Destroying Wildlife Resources——Taking for Example the Illegal Trade of Wild Chinese Toads
In the process of our investigation,we have found that some crimes that endanger wildlife resources have formed a large-scale and industrialized criminal web.After the mechanism established to completely ban the consumption of wild animals and in order to terminate the interest chain,we should target and combat the entire chain such as illegal hunting,transportation,purchase,processing,sales and other links.We should apply appropriate charges against the criminals after taking into comprehensive consideration their subjective purpose,usages of wild animals and products,the degree of harm to animal resources caused by their behavior,and the role in the criminal chain.Especially to those scattering purchasers,we cannot mechanically refer to their behavior as upstream link,and should conduct a comprehensive evaluation based on the dual value for food purpose or medical one in the transaction.
