摘要
公安机关在案件办理过程中使用"非现场打击手段"对黄赌违法犯罪开展调查、侦查,是新形势打击违法犯罪的手段创新.但"非现场打击手段"应用与现有法律规定的执法程序、证据效力和结果适用方面还存在一些问题或不足,需要从完善程序立法、加强法律监督、强化公安机关内部监督等方面开展有效规制.
Abstract
In the process of handling cases police agencies use"off-scene combat means"to conduct investigation into prostitution and gambling,which is an innovated means to fight against illegal crime in the new situation.However,there are still some problems or shortcomings in its application,and the law enforcement procedures,evidence effectiveness and results that the existing laws provide.As such,it is necessary to conduct effective regulation in terms of perfecting procedural legislation,strengthening legal supervision and internal supervision of police agencies.
