GHG减排对国际航运的法律影响及中国对策研究

"双碳"战略理念与全球生态保护倡议相吻合,航运业面临相同的挑战.IMO航运减碳战略为构建国际绿色航运法制体系提供了关键指引,却尚未形成立法体系,国际社会面临绿色航运立法碎片化问题,各区域单边立法产生绿色壁垒,对国际航运业造成威胁,国际绿色航运法律体系的构建迫在眉睫.通过对IMO海事减碳战略和欧盟FuelEUMaritime法规的研究可知,国际社会正在对绿色航运进行新一轮的技术革新.我国应当抓住机遇,参与IMO国际绿色航运法律建设,以国际法为基础,加强国内引导,鼓励技术创新,推动国内航运业整体绿色转型,打破绿色贸易壁垒,提升国际航运竞争力.
Legal Impact of Green-House Gas Emission Reduction on International Shipping and Research on China's Counter-measures
The"Double Carbon"strategic concept is consistent with the global ecological protection ini-tiative,and the shipping industry faces the same challenges.The IMO Shipping Carbon Reduction Strategy provides key guidance for building an international green shipping legal system,but a legisla-tive system has not yet been formed.The international community is facing the problem of fragmenta-tion of green shipping legislation.Unilateral legislation in various regions creates green barriers,posing a threat to the international shipping industry.The construction of a green shipping legal system is im-minent.Through research on the IMO Maritime Carbon Reduction Strategy and the EU FuelEU Mari-time Regulations,it can be seen that the international community is carrying out a new round of techno-logical innovation for green shipping.China should seize the opportunity to participate in the construc-tion of IMO international green shipping laws,base on international law,strengthen domestic guidance,encourage technological innovation,promote the overall green transformation of the domestic shipping industry,break down green trade barriers,and enhance the competitiveness of international shipping.
