The Cultural Implication of"Zhi Fa Ru Shan"and Its Contemporary Inheritance
The practice of"Zhi Fa Ru Shan"(Law enforcement allows no wavering)is one of the essential elements in excellent traditional Chinese legal culture.In ancient China,when a litigation dispute arose,the public often prayed for"Qing Tian"(honest and upright officials)to uphold justice and judge cases with the position and norms of fairness and justice,their behavior can be called"Zhi Fa Ru Shan".A large number of literary artistic works,such as dramas and fictions,and documented files reflect the psychology of the public.The idea of"Zhi Fa Ru Shan",dating back to pre-Qin Dynasty,was institutionalized in the Qin Dynasty and then became systematically developed in the Tang Dynasty,and further perfected with its practice in the Song and Ming dynasties.In ancient China,though this idea was essentially in accordance with the emperor's sovereignty by constraining the people'conducts,the strict implementation of the law had also avoided the risk of the government infringing on the rights and interests of the public at will.Against this background,the culture of Qing Guan(incorruptible and impartial magistrates)in pursuit of unwavering law enforcement has been enshrined with new definitions in the rule of law in the new era,and its original spirit can still provide enlightening reference for the construction of socialist rule of law with Chinese characteristics.It is expected that the study of the time-honored idea can ensure the integrity of law enforcement and judicial fairness,further improve the present law enforcement and judicial environment,and let the spirit of law enforcement be passed on from generation to generation.
