摘要
日常性违规广泛存在于基层社会,对科层化运作的常规治理机制形成挑战.为应对这一挑战,科层组织衍生出集中执法机制.这一机制是集中力量办大事的治理机制在基层执法领域的延续,在实践中具有突出成效.通过改变常规的运作模式,科层组织集中了分散的执法信息、权限和人员,以统一执法目标、增强执法权威、提高执法密度.在这一过程中,治理资源下沉至基层并得到有效运用,抑制了内部能力损耗.同时,集中执法机制注重因势利导,能够增强基层执法人员的权威,有效提升了基层应对日常性违规的能力.然而,这一机制仍存在继续优化的空间.可通过扩大辅助执法的主体范围,优化执法资源的分配机制以及拓展违规行为的干预路径等方式,进一步提升集中执法机制的实效.
Abstract
Routine infractions are prevalent in grassroots communities,posing challenges to the conventional governance mechanisms of bureaucratized operations.In response to this challenge,hierarchical organizations have developed a centralized enforcement mechanism.This mechanism represents a continuation of the governance approach of concentrating efforts to accomplish significant tasks in the field of grassroots law enforcement and has demonstrated outstanding effectiveness in practice.By altering conventional operational patterns,hierarchical organizations consolidate dispersed enforcement information,authority,and personnel to achieve unified enforcement objectives,enhance enforcement legitimacy,and increase enforcement intensity.In this process,governance resources are decentralized to grassroots levels and effectively utilized,thereby mitigating internal capacity depletion.Simultaneously,the centralized enforcement mechanism emphasizes adaptive governance,which can bolster the authority of grassroots law enforcement personnel,effectively enhancing grassroots capabilities to address routine infractions.However,this mechanism still can be further optimized.Enhancements could include expanding the scope of auxiliary enforcement actors,optimizing the allocation mechanism of enforcement resources,and broadening intervention pathways for infractions,all of which would further enhance the effectiveness of the centralized enforcement mechanism.
